Nen\u00ed v\u0161ak jedin\u00e1, kter\u00e1 byla ohro\u017eena nebo p\u0159\u00edmo vytla\u010dena sez\u00f3nn\u00edm pron\u00e1jmem. Tento typ smlouvy, <a href=\"https:\/\/www.eldiario.es\/economia\/alquiler-temporada-trampa-esquivar-ley-vivienda-precios-35-caros_1_10301716.html\">kter\u00fd se vymyk\u00e1 p\u0159edpis\u016fm o pron\u00e1jmu<\/a>, se v katal\u00e1nsk\u00e9m hlavn\u00edm m\u011bst\u011b v posledn\u00edch m\u011bs\u00edc\u00edch prudce zv\u00fd\u0161il a podle dostupn\u00fdch \u00fadaj\u016f tvo\u0159\u00ed 20 a\u017e 40 % nab\u00eddky na realitn\u00edch port\u00e1lech, jako je Idealista.<\/p>\n\n<p>Podle r\u016fzn\u00fdch osloven\u00fdch zdroj\u016f je jeho n\u00e1r\u016fst zaznamen\u00e1v\u00e1n ji\u017e n\u011bkolik let, a to soub\u011b\u017en\u011b se schvalov\u00e1n\u00edm r\u016fzn\u00fdch p\u0159edpis\u016f, kter\u00e9 zv\u00fdhod\u0148uj\u00ed n\u00e1jemce, jako je prodlou\u017een\u00ed smluv ze t\u0159\u00ed na p\u011bt let nebo cenov\u00fd strop. Do\u010dasn\u00fd pron\u00e1jem umo\u017e\u0148uje pronaj\u00edmateli uzav\u00edrat ro\u010dn\u00ed smlouvy, a tud\u00ed\u017e m\u00e1 v\u011bt\u0161\u00ed svobodu je zdra\u017eit nebo vypov\u011bd\u011bt.  <\/p>\n\n<p>Barcelona je v\u0161ak tak\u00e9 ovlivn\u011bna rostouc\u00edm p\u0159\u00edlivem zahrani\u010dn\u00edch pracovn\u00edk\u016f &#8211; v\u011bt\u0161inou digit\u00e1ln\u00edch nom\u00e1d\u016f -, kte\u0159\u00ed do m\u011bsta p\u0159ij\u00ed\u017ed\u011bj\u00ed kv\u016fli jeho dobr\u00e9mu klimatu. Zpr\u00e1va spole\u010dnosti Idealista za t\u0159et\u00ed \u010dtvrtlet\u00ed roku 2023 hovo\u0159\u00ed o &#8222;raketov\u00e9m&#8220; vzestupu na 28 % trhu s pron\u00e1jmy v katal\u00e1nsk\u00e9m hlavn\u00edm m\u011bst\u011b, kter\u00e9 je ve \u0160pan\u011blsku druh\u00e9 za San Sebastianem. Podle jin\u00e9 studie Observatori de l&#8217;Habitatge de Barcelona (OH-B), kter\u00e1 se t\u00fdkala reklam od stejn\u00e9 spole\u010dnosti a ze stejn\u00e9ho obdob\u00ed, \u010dinil tento pod\u00edl 19 %, ale v n\u011bkter\u00fdch \u010dtvrt\u00edch, nap\u0159\u00edklad v Barcelonet\u011b, se bl\u00ed\u017eil 50 %.<\/p>\n\n<p>Od t\u00e9 doby nebyly publikov\u00e1ny \u017e\u00e1dn\u00e9 dal\u0161\u00ed studie. Nov\u011bj\u0161\u00ed anal\u00fdza port\u00e1lu <a href=\"https:\/\/eldiario.es\/\" target=\"_blank\" rel=\"noreferrer noopener\">elDiario.es<\/a> v\u0161ak potvrzuje vzestupn\u00fd trend. Od \u0159\u00edjna 2023 do b\u0159ezna 2024 po\u010d\u00edtaj\u00ed tyto noviny ka\u017ed\u00fd 15. den v\u0161echny inzer\u00e1ty dostupn\u00e9 na port\u00e1lu Idealista. V\u00fdsledkem je, \u017ee u\u017eivatel\u00e9 se v pr\u016fm\u011bru setk\u00e1vaj\u00ed se 46 % reklam na do\u010dasn\u00e9 pron\u00e1jmy. V n\u011bkter\u00fdch \u010dtvrt\u00edch v centru m\u011bsta se pohybuje kolem 60 % (Barceloneta, Hostafrancs, Esquerra de l&#8217;Eixample a Sant Antoni).<\/p>\n\n<p>Navzdory rozd\u00edl\u016fm mezi jednotliv\u00fdmi zpr\u00e1vami odborn\u00edci poukazuj\u00ed na to, \u017ee o jeho r\u016fstu nen\u00ed pochyb. &#8222;Doch\u00e1z\u00ed k jasn\u00e9mu p\u0159esunu obydl\u00ed, kter\u00e1 byla nab\u00edzena k pron\u00e1jmu jako obytn\u00e9 domy a nyn\u00ed se z nich st\u00e1vaj\u00ed sez\u00f3nn\u00ed nebo turistick\u00e9 objekty,&#8220; \u0159\u00edk\u00e1 Helena Cruz, geografka a autorka studie OH-B. Porovn\u00e1v\u00e1 tak\u00e9 v\u00fdvoj konven\u010dn\u00ed a do\u010dasn\u00e9 nab\u00eddky a cestovn\u00edho ruchu v letech 2022-2023. Zat\u00edmco prvn\u00ed z nich kles\u00e1 o 895 byt\u016f, druh\u00fd stoup\u00e1 o 830. Jeho z\u00e1v\u011br je, \u017ee se jedn\u00e1 o komunika\u010dn\u00ed n\u00e1doby.<\/p>\n\n<p>To je nav\u00edc k vy\u0161\u0161\u00edm cen\u00e1m. Jeho pan\u00ed je velkostatk\u00e1\u0159ka, kter\u00e1 vlastn\u00ed n\u011bkolik nemovitost\u00ed, v\u010detn\u011b vlastn\u00ed patn\u00e1ctipatrov\u00e9 nemovitosti. &#8222;On nepot\u0159ebuje o t\u0159i stovky m\u011bs\u00ed\u010dn\u011b v\u00edc, zat\u00edmco pro m\u011b to znamen\u00e1, jestli budu moci platit za byt,&#8220; dod\u00e1v\u00e1.  <\/p>\n\n<h4 class=\"wp-block-heading\"><strong>Vodn\u00ed cesta&#8230; a podvod na z\u00e1kon\u011b?<\/strong><\/h4>\n\n<p>Pro sdru\u017een\u00ed n\u00e1jemn\u00edk\u016f se existence do\u010dasn\u00e9ho pron\u00e1jmu stala skute\u010dnou mezerou v z\u00e1kon\u011b o bydlen\u00ed, kter\u00e1 je\u0161t\u011b v\u00edce zat\u011b\u017euje trh s n\u00e1jemn\u00edmi byty a kterou by m\u011bla st\u00e1tn\u00ed spr\u00e1va zacelit. Pro tuto oblast v\u0161ak neexistuje \u017e\u00e1dn\u00e9 na\u0159\u00edzen\u00ed. Ministerstvo pro bydlen\u00ed v prosinci z\u0159\u00eddilo komisi, kter\u00e1 ji m\u00e1 prozkoumat a zat\u00edm se se\u0161la jen jednou, zat\u00edmco Generalitat tvrd\u00ed, \u017ee p\u0159ipravuje nov\u00e9 na\u0159\u00edzen\u00ed, kter\u00e9 v\u0161ak nem\u016f\u017ee b\u00fdt schv\u00e1leno kv\u016fli p\u0159ed\u010dasn\u00fdm volb\u00e1m 12. kv\u011btna.<\/p>\n\n<p>V sou\u010dasn\u00e9 dob\u011b je ve 140 katal\u00e1nsk\u00fdch obc\u00edch, kde plat\u00ed horn\u00ed hranice n\u00e1jemn\u00e9ho, r\u016fst cen omezen. Proto n\u011bkte\u0159\u00ed pronaj\u00edmatel\u00e9 pova\u017euj\u00ed sez\u00f3nn\u00ed pron\u00e1jem za zkratku ke zv\u00fd\u0161en\u00ed cen. Pr\u00e1vn\u00edci zab\u00fdvaj\u00edc\u00ed se bydlen\u00edm v\u0161ak varuj\u00ed, \u017ee pokud by se tak stalo v p\u0159\u00edpad\u011b n\u00e1jemn\u00edk\u016f, kte\u0159\u00ed nemovitost u\u017e\u00edvaj\u00ed jako sv\u016fj domov, pronaj\u00edmatel\u00e9 by poru\u0161ili z\u00e1kon. &#8222;Existuj\u00ed pronaj\u00edmatel\u00e9, kte\u0159\u00ed inzeruj\u00ed sez\u00f3nn\u00ed pron\u00e1jmy a uv\u00e1d\u011bj\u00ed to ve smlouv\u00e1ch, ale ve skute\u010dnosti pronaj\u00edmaj\u00ed nemovitost lidem, kte\u0159\u00ed ji vyu\u017e\u00edvaj\u00ed jako sv\u00e9 obvykl\u00e9 bydli\u0161t\u011b, co\u017e je podvodn\u00e9 vyu\u017eit\u00ed tohoto \u00fadaje,&#8220; varuje Elga Molina, pr\u00e1vn\u00ed poradkyn\u011b pro ot\u00e1zky bydlen\u00ed.<\/p>\n\n<p>To je p\u0159\u00edpad osmadvacetilet\u00e9 Pauly Fern\u00e1ndezov\u00e9, kter\u00e1 sd\u00edl\u00ed byt s dal\u0161\u00edmi t\u0159emi d\u00edvkami v Cerdanyola del Vall\u00e8s v barcelonsk\u00e9 metropolitn\u00ed oblasti. P\u0159esto\u017ee v dom\u011b bydl\u00ed ji\u017e \u010dty\u0159i roky a jsou v n\u011bm p\u0159ihl\u00e1\u0161eni, maj\u00ed sez\u00f3nn\u00ed smlouvu. P\u0159ed nov\u00fdm z\u00e1konem o bydlen\u00ed m\u011bli n\u00e1jemn\u00ed smlouvu na byt, ale kdy\u017e nastal \u010das ji prodlou\u017eit, pronaj\u00edmatel jim \u0159ekl, \u017ee bu\u010f podep\u00ed\u0161ou smlouvu na rok, nebo nic.<\/p>\n\n<p>&#8222;Byli jsme zasko\u010deni a ze strachu, \u017ee z\u016fstaneme bez domova, jsme se pod\u0159\u00eddili,&#8220; vysv\u011btluje Paula. Bylo z\u00e1\u0159\u00ed 2022. O rok pozd\u011bji smlouva vypr\u0161ela a museli ji podepsat znovu. Jejich pronaj\u00edmatel op\u011bt navrhl dvan\u00e1ctim\u011bs\u00ed\u010dn\u00ed lh\u016ftu, ale po Paulin\u011b nal\u00e9h\u00e1n\u00ed souhlasili s dvouletou lh\u016ftou pod podm\u00ednkou, \u017ee budou zaps\u00e1ni jako studenti (a\u010dkoli jimi nejsou).<\/p>\n\n<p>Postava sez\u00f3nn\u00edho pron\u00e1jmu nen\u00ed v z\u00e1kon\u011b o m\u011bstsk\u00e9m pron\u00e1jmu (LAU) p\u0159\u00edli\u0161 rozpracov\u00e1na, ale z\u00e1kon alespo\u0148 jasn\u011b uv\u00e1d\u00ed, \u017ee je ur\u010den pro jin\u00e9 \u00fa\u010dely ne\u017e bydlen\u00ed. Nap\u0159\u00edklad studenti a doktorandi, kte\u0159\u00ed tudy proj\u00ed\u017ed\u011bj\u00ed, vysoce mobiln\u00ed odborn\u00edci nebo digit\u00e1ln\u00ed nom\u00e1di, lid\u00e9, jejich\u017e domovy jsou ve v\u00fdstavb\u011b&#8230; &#8222;O tom, zda se jedn\u00e1 o sez\u00f3nn\u00ed smlouvu, rozhoduje d\u016fvod, nikoli d\u00e9lka pobytu, a ten mus\u00ed b\u00fdt akreditov\u00e1n, v\u010detn\u011b p\u0159edlo\u017een\u00ed pracovn\u00ed smlouvy,&#8220; dod\u00e1v\u00e1 Molina.<\/p>\n\n<p>Nikdo v\u0161ak po Fernandezovi nepo\u017eadoval, aby prok\u00e1zal, \u017ee je studentem. J\u00e1 bych to nedok\u00e1zal. &#8222;Je to smlouva, jej\u00edm\u017e jedin\u00fdm \u00fa\u010delem je poru\u0161it z\u00e1kon a \u00fa\u010dtovat si v\u00edce,&#8220; lituje. Od doby, kdy podepsali sez\u00f3nn\u00ed n\u00e1jem, plat\u00ed m\u011bs\u00ed\u010dn\u011b o 120 eur v\u00edce, tedy a\u017e 1 120 eur, zat\u00edmco jejich byt by podle stropu stanoven\u00e9ho vl\u00e1dn\u00edm indexem m\u011bl st\u00e1t 600 a\u017e 700 eur.<\/p>\n\n<p>&#8222;Je to hrozn\u00e9, po\u0159\u00e1d sleduj\u00ed na\u0161e pohyby. P\u011bt byt\u016f, kter\u00e9 ji\u017e byly uvoln\u011bny, bylo zrekonstruov\u00e1no a jsou pronaj\u00edm\u00e1ny na z\u00e1klad\u011b sez\u00f3nn\u00edch smluv.
