Dne 11. b\u0159ezna 2024 schv\u00e1lili minist\u0159i zam\u011bstnanosti 27 \u010dlensk\u00fdch st\u00e1t\u016f EU&nbsp;<a href=\"https:\/\/www.consilium.europa.eu\/fr\/press\/press-releases\/2024\/03\/11\/platform-workers-council-confirms-agreement-on-new-rules-to-improve-their-working-conditions\/\" target=\"_blank\" rel=\"noreferrer noopener\">dohodu<\/a>&nbsp;o n\u00e1vrhu sm\u011brnice o regulaci trhu pr\u00e1ce internetov\u00fdch platforem. Jedn\u00e1 se o prvn\u00ed evropsk\u00fd z\u00e1kon, kter\u00fd stanov\u00ed minim\u00e1ln\u00ed pracovn\u00ed podm\u00ednky pro 28 milion\u016f pracovn\u00edk\u016f platforem, jako jsou Uber a Deliveroo.<\/p>\n\n\n\n<p>&#8222;Je to samoz\u0159ejm\u011b \u00fasp\u011bch, p\u0159inejmen\u0161\u00edm symbolick\u00fd,&#8220; \u0159\u00edk\u00e1 politolog Kurt Vandaele, kter\u00fd zdokumentoval boj doru\u010dovatel\u016f v&nbsp;<a href=\"https:\/\/voxeurop.eu\/en\/country\/belgium-2\/\">Belgii<\/a>. &#8222;Evropsk\u00e1 konfederace odborov\u00fdch svaz\u016f<\/a>&nbsp;(ETUC) ji\u017e l\u00e9ta lobbuje u poslanc\u016f Evropsk\u00e9ho parlamentu a Komise za regulaci &#8222;ekonomiky platforem&#8220;.<\/p>&#8220; <a href=\"https:\/\/www.etuc.org\/en\" target=\"_blank\" rel=\"noreferrer noopener\">.\n\n\n\n<p>Dv\u011b zem\u011b dohodu nepodpo\u0159ily:&nbsp;<a href=\"https:\/\/voxeurop.eu\/en\/country\/germany\/\">N\u011bmecko<\/a>, kter\u00e9 se zdr\u017eelo hlasov\u00e1n\u00ed, a&nbsp;<a href=\"https:\/\/voxeurop.eu\/en\/country\/france-2\/\">Francie<\/a>, kter\u00e1 hlasovala proti. &#8222;Od t\u00e9to chv\u00edle bude hodn\u011b z\u00e1le\u017eet na tom, jak bude sm\u011brnice transponov\u00e1na a implementov\u00e1na v \u010dlensk\u00fdch st\u00e1tech,&#8220; \u0159\u00edk\u00e1 Vandaele. &#8222;Nemluv\u011b o lobbistick\u00e9 s\u00edle platforem. \u010cek\u00e1 n\u00e1s je\u0161t\u011b dlouh\u00e1 a obt\u00ed\u017en\u00e1 cesta.&#8220;<\/p>\n\n\n\n<p>Ale v\u00edt\u011bzstv\u00ed je st\u00e1le v\u00edt\u011bzstv\u00ed. V posledn\u00edch letech bylo takov\u00fdch v\u00edt\u011bzstv\u00ed na soci\u00e1ln\u00ed front\u011b m\u00e1lo.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Jsou odbory v \u00fapadku? <\/strong><\/h4>\n\n\n\n<p>Od 80. let 20. stolet\u00ed doch\u00e1z\u00ed ve v\u011bt\u0161in\u011b z\u00e1padn\u00edch zem\u00ed k oslabov\u00e1n\u00ed odborov\u00e9ho hnut\u00ed. To odr\u00e1\u017e\u00ed zm\u011bny na trhu pr\u00e1ce: prudk\u00fd n\u00e1r\u016fst outsourcingu slu\u017eeb, zejm\u00e9na v odv\u011btv\u00ed \u00faklidu a dom\u00e1c\u00ed v\u00fdpomoci, p\u0159\u00edle\u017eitostn\u00e9 zam\u011bstn\u00e1v\u00e1n\u00ed s n\u00e1r\u016fstem pr\u00e1ce na objedn\u00e1vku a samostatn\u00e9 v\u00fdd\u011ble\u010dn\u00e9 \u010dinnosti, obecnou fragmentaci pracovn\u00edch vztah\u016f a struktur\u00e1ln\u00ed reformy, kter\u00e9 zpochyb\u0148uj\u00ed fungov\u00e1n\u00ed odbor\u016f.<\/p>\n\n\n\n<p>Pokud se lze \u0159\u00eddit evropsk\u00fdmi&nbsp;<a href=\"https:\/\/www.oecd.org\/employment\/ictwss-database.htm\" target=\"_blank\" rel=\"noreferrer noopener\">odborov\u00fdmi m\u00edrami<\/a>&nbsp;ukazateli, obecn\u00fd trend poklesu po\u010dtu \u010dlen\u016f odbor\u016f se v posledn\u00edch letech nezm\u011bnil, a to bez ohledu na n\u00e1r\u016fst po pandemii a skokov\u00e9 inflaci. &#8222;Pohled na m\u00edru odborov\u00e9 organizovanosti nesta\u010d\u00ed,&#8220; domn\u00edv\u00e1 se sociolo\u017eka Cristina Nizzoliov\u00e1, autorka knihy C&#8217;est du propre! Syndicalisme et travailleurs du &#8218;bas de l&#8217;\u00e9chelle'&#8220; (Marseille a Bologna) (PUF, 2015). &#8222;D\u016fle\u017eit\u00e9 je pochopit, co motivuje \u010dlenstv\u00ed a d\u00e1v\u00e1 odbor\u016fm smysl. Kdy\u017e vid\u00edme nap\u0159\u00edklad mobilizaci kv\u016fli d\u016fchod\u016fm v&nbsp;<a href=\"https:\/\/voxeurop.eu\/en\/country\/france-2\/\">Francii<\/a>&nbsp;roce 2023, zd\u00e1 se mi nespr\u00e1vn\u00e9 mluvit o \u00fapadku odbor\u016f.&#8220;<\/p>\n\n\n\n<p>Kurt Vandaele se vyjad\u0159uje podobn\u011b. Poukazuje na masivn\u00ed&nbsp;<a href=\"https:\/\/www.lesechos.fr\/monde\/europe\/pays-bas-les-fonctionnaires-municipaux-obtiennent-gain-de-cause-sur-les-salaires-1909126\" target=\"_blank\" rel=\"noreferrer noopener\">mobilizaci<\/a>&nbsp;v nizozemsk\u00e9 st\u00e1tn\u00ed spr\u00e1v\u011b na za\u010d\u00e1tku roku 2023 a&nbsp;<a href=\"https:\/\/www.usinenouvelle.com\/article\/entre-tesla-et-le-syndicat-allemand-ig-metall-le-ton-se-durcit.N2102786\" target=\"_blank\" rel=\"noreferrer noopener\">bezprecedentn\u00ed bitvu<\/a>&nbsp;vedenou tis\u00edcovkou n\u011bmeck\u00fdch zam\u011bstnanc\u016f Tesly, kte\u0159\u00ed vstoupili do siln\u00fdch odbor\u016f IG Metall, aby dos\u00e1hli lep\u0161\u00edch pracovn\u00edch podm\u00ednek.<\/p>\n\n\n\n<p>Mutace pracovn\u00edho trhu v\u0161ak zcela jist\u011b nut\u00ed tradi\u010dn\u00ed odborov\u00e9 organizace p\u0159ehodnotit sv\u00e9 postupy a c\u00edle.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>&#8222;Prvn\u00edm krokem je proniknout do &#8218;odbor\u00e1\u0159sk\u00e9 pou\u0161t\u011b'&#8220; &#8211; Jacques Freyssinet<\/strong><\/h5>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p>Cristina Nizzoliov\u00e1 studovala odv\u011btv\u00ed, kde je st\u00e1le v\u00edce pracovn\u00edch sil p\u0159ist\u011bhovalc\u016f, \u017een a lid\u00ed sn\u011bd\u00e9 pleti &#8211; nap\u0159\u00edklad ukl\u00edze\u010dky ve Francii a&nbsp;<a href=\"https:\/\/voxeurop.eu\/en\/country\/italy-2\/\">It\u00e1lii<\/a>. &#8222;Je p\u016fsobiv\u00e9 vid\u011bt, jak tito nejist\u00ed pracovn\u00edci s tak skromn\u00fdmi prost\u0159edky &#8211; a nejen finan\u010dn\u00edmi &#8211; sv\u00e1d\u011bj\u00ed bitvy, kter\u00e9 trvaj\u00ed cel\u00e9 m\u011bs\u00edce. [&#8230;] Tito lid\u00e9 nemaj\u00ed stejnou situaci jako pracovn\u00edci platforem, ale je zaj\u00edmav\u00e9 sledovat, jak jejich mobilizace zpochyb\u0148uje tradi\u010dn\u00ed odborov\u00fd syst\u00e9m, zejm\u00e9na v ot\u00e1zce jeho struktury a zp\u016fsobu, jak\u00fdm zastupuje pracovn\u00edky.&#8220;<\/p>\n\n\n\n<p>P\u0159izp\u016fsoben\u00ed nen\u00ed snadn\u00e9. &#8222;Je tomu tak zejm\u00e9na v zem\u00edch, jako je Francie a It\u00e1lie, kde jsou odbory organizov\u00e1ny konfederativn\u011b a p\u0159izp\u016fsobeny tradi\u010dn\u00ed placen\u00e9 pracovn\u00ed s\u00edle,&#8220; vysv\u011btluje sociolog. Rozt\u0159\u00ed\u0161t\u011bnost t\u00e9to pracovn\u00ed s\u00edly znamen\u00e1, \u017ee na pracovn\u00edky v dom\u00e1cnosti, pomocn\u00edky v dom\u00e1cnosti a ukl\u00edze\u010de se m\u016f\u017ee vztahovat n\u011bkolik r\u016fzn\u00fdch kolektivn\u00edch smluv. Zkoum\u00e1n\u00ed jejich situace podle federac\u00ed proto nesta\u010d\u00ed k z\u00edsk\u00e1n\u00ed celkov\u00e9ho pohledu na jejich pracovn\u00ed podm\u00ednky.<\/p>\n\n\n\n<p>V\u00fdzkumn\u00edk si v\u0161\u00edm\u00e1 \u00falohy, kterou hraj\u00ed odbory zdola na m\u00edstn\u00ed a region\u00e1ln\u00ed \u00farovni. To &#8222;umo\u017e\u0148uje vytvo\u0159it dlouhodob\u00e9 spojen\u00ed s pracovn\u00edky&#8220;. Postup prost\u0159ednictv\u00edm m\u00edstn\u00edch odbor\u016f tak\u00e9 pom\u00e1h\u00e1 obej\u00edt tlak zam\u011bstnavatel\u016f na pracovi\u0161ti. Jak v\u0161ak upozor\u0148uje Nizzoli, zd\u00e1 se, \u017ee tyto m\u00edstn\u011b p\u016fsob\u00edc\u00ed odbory jsou st\u00e1le do zna\u010dn\u00e9 m\u00edry z\u00e1visl\u00e9 na dlouholet\u00fdch aktivistech, kte\u0159\u00ed je vedou, a zat\u00edm nedo\u0161lo k \u017e\u00e1dn\u00e9mu skute\u010dn\u00e9mu p\u0159ehodnocen\u00ed v t\u00e9to oblasti.<\/p>\n\n\n\n<p>Kurt Vandaele dod\u00e1v\u00e1: &#8222;Vzestup subdod\u00e1vek vy\u017eaduje &#8218;odbory s\u00ed\u0165ov\u00e9ho typu&#8216;, lep\u0161\u00ed spolupr\u00e1ci mezi st\u00e1vaj\u00edc\u00edmi odborov\u00fdmi organizacemi a tak\u00e9 zm\u011bnu n\u011bkter\u00fdch struktur. C\u00edlem je vybudovat d\u016fv\u011bru, co\u017e m\u016f\u017ee \u010dasto vy\u017eadovat znalost jin\u00e9ho jazyka, ne\u017e je jazyk dan\u00e9 zem\u011b.&#8220;<\/p>\n\n\n\n<p>V Belgii a Nizozemsku se v roce 2017 organiza\u010dn\u00ed s\u00edla platforem pro rozvoz j\u00eddla prom\u00edtla do online digit\u00e1ln\u00edch komunit a odtud do aktivistick\u00fdch skupin. &#8222;Siln\u00fd narativ kolem kur\u00fdr\u016f hr\u00e1l hlavn\u00ed roli,&#8220; vypr\u00e1v\u00ed Kurt Vandaele. &#8222;Vzhledem k tomu, \u017ee ekonomika platforem je st\u00e1le relativn\u011b nov\u00e1, tradi\u010dn\u00ed odbory nejsou aktivn\u00ed, ale naslouchaj\u00ed st\u00ed\u017enostem a n\u00e1vrh\u016fm kur\u00fdr\u016f,&#8220; dod\u00e1v\u00e1.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Pronik\u00e1n\u00ed do &#8222;pou\u0161t\u00ed odbor\u016f<\/strong>&#8222;<\/h4>\n\n\n\n<p>Anglicky mluv\u00edc\u00ed zem\u011b maj\u00ed dlouhou tradici &#8222;organizov\u00e1n\u00ed&#8220;, kter\u00e9 spo\u010d\u00edv\u00e1 ve vyu\u017e\u00edv\u00e1n\u00ed komunitn\u00edch s\u00edt\u00ed k osloven\u00ed specifick\u00fdch kategori\u00ed pracovn\u00edk\u016f, jako jsou p\u0159ist\u011bhovalci, \u017eeny nebo mlad\u00ed lid\u00e9 s nejist\u00fdmi smlouvami. Cristina Nizzoliov\u00e1 vysv\u011btluje: &#8222;D\u011bje se tak mimo hranice podniku a tradi\u010dn\u00edch odbor\u016f, s vyu\u017eit\u00edm aktivistick\u00fdch osobnost\u00ed, kter\u00e9 pracuj\u00ed prost\u0159ednictv\u00edm komunit, a\u0165 u\u017e se jedn\u00e1 o c\u00edrkev, etnickou skupinu nebo komunitu p\u0159ist\u011bhovalc\u016f.&#8220;<\/p>\n\n\n\n<p>C\u00edlem je j\u00edt nad r\u00e1mec pouh\u00e9ho z\u00edsk\u00e1v\u00e1n\u00ed \u010dlen\u016f ze skupin s n\u00edzkou \u00farovn\u00ed \u010dlenstv\u00ed v odborech a usilovat o pos\u00edlen\u00ed postaven\u00ed t\u011bchto skupin. Ekonom&nbsp;<a href=\"https:\/\/fr.wikipedia.org\/wiki\/Jacques_Freyssinet\" target=\"_blank\" rel=\"noreferrer noopener\">Jacques Freyssinet<\/a>&nbsp;to rozv\u00e1d\u00ed: &#8222;Prvn\u00edm krokem je samoz\u0159ejm\u011b proniknout do &#8218;odborov\u00fdch pou\u0161t\u00ed&#8216;. Jak vypr\u00e1v\u00ed Jacques Freyssinet v knize &#8222;<a href=\"https:\/\/www.cairn.info\/revue-chronique-internationale-de-l-ires-2017-4-page-38.htm\" target=\"_blank\" rel=\"noreferrer noopener\">Tensions et ambigu\u00eft\u00e9s dans la strat\u00e9gie d&#8217;organising<\/a>&#8222;, hlavn\u00ed n\u011bmeck\u00fd odborov\u00fd svaz kovod\u011bln\u00edk\u016f IG Metall byl nucen p\u0159ehodnotit svou institucion\u00e1ln\u00ed strategii, soust\u0159ed\u011bnou na p\u0159\u00edstup zalo\u017een\u00fd na vyjedn\u00e1v\u00e1n\u00ed mezi odbory, a p\u0159epracovat sv\u016fj reperto\u00e1r taktik.<\/p>\n\n\n\n<p>Z iniciativy frankfurtsk\u00e9 centr\u00e1ly IG Metall byl z\u0159\u00edzen inova\u010dn\u00ed fond zam\u011b\u0159en\u00fd na odborovou \u010dinnost (v hodnot\u011b 16-20 milion\u016f eur ro\u010dn\u011b). Nov\u00e9 veden\u00ed odbor\u016f tak\u00e9 podporuje n\u00e1bor mlad\u00fdch st\u00e1l\u00fdch zam\u011bstnanc\u016f se zku\u0161enostmi s aktivitou v soci\u00e1ln\u00edch hnut\u00edch. Uvoln\u011bn\u00e9 prost\u0159edky na centr\u00e1ln\u00ed \u00farovni jsou sm\u011b\u0159ov\u00e1ny do organiza\u010dn\u00edch kampan\u00ed v odv\u011btv\u00edch s n\u00edzkou hustotou odbor\u016f. Od roku 2010 do roku 2016 vzrostl po\u010det \u010dlen\u016f IG Metall z 1,8 milionu na 2,2 milionu.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Podpora kolektivn\u00edho ducha<\/strong><\/h4>\n\n\n\n<p>Nezaji\u0161t\u011bn\u00fdm pracovn\u00edk\u016fm mimo &#8222;tradi\u010dn\u00ed&#8220; pracovn\u00ed s\u00edlu se dost\u00e1v\u00e1 podpory i od hr\u00e1\u010d\u016f, kte\u0159\u00ed nejsou \u010dleny odbor\u016f. Symbolick\u00fd je p\u0159\u00edpad&nbsp;<a href=\"https:\/\/laskellys.wordpress.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">kolektivu Las Kellys<\/a>, kter\u00fd vznikl v roce 2014 v&nbsp;<a href=\"https:\/\/voxeurop.eu\/en\/country\/spain\/\">\u0160pan\u011blsku<\/a>. Toto sdru\u017een\u00ed sdru\u017eovalo hotelov\u00e9 ukl\u00edze\u010de &#8211; n\u011bkter\u00e9 z nich imigranty s n\u00edzk\u00fdm form\u00e1ln\u00edm vzd\u011bl\u00e1n\u00edm &#8211; kte\u0159\u00ed byli odhodl\u00e1ni kolektivn\u011b bojovat navzdory nedostate\u010dn\u00e9 podpo\u0159e ze strany hlavn\u00edch odborov\u00fdch konfederac\u00ed.<\/p>\n\n\n\n<p>Jejich st\u00ed\u017enosti se zam\u011b\u0159ovaly na zhor\u0161en\u00ed jejich pracovn\u00edch podm\u00ednek a ekonomickou nejistotu zp\u016fsobenou syst\u00e9mem subdod\u00e1vek platn\u00fdm v hotelov\u00e9m sektoru. &#8222;S\u00edt\u011b aktivist\u016f jsou velmi u\u017eite\u010dn\u00e9 pro zaji\u0161t\u011bn\u00ed toho, aby kampan\u011b \u0161ly na dra\u010dku, a pro z\u00edsk\u00e1v\u00e1n\u00ed pen\u011bz, organizov\u00e1n\u00ed st\u00e1vkov\u00fdch fond\u016f atd. Zdr\u00e1hala bych se v\u0161ak \u0159\u00edci, \u017ee se jedn\u00e1 o nov\u00fd fenom\u00e9n,&#8220; \u0159\u00edk\u00e1 Cristina Nizzoliov\u00e1. &#8222;Od 90. let jsme byli sv\u011bdky mnoha p\u0159\u00edpad\u016f, kdy se pracovn\u00edci bez doklad\u016f mobilizovali s podporou aktivistick\u00fdch skupin.&#8220;<\/p>\n\n\n\n<p>Organizace a vytv\u00e1\u0159en\u00ed vazeb s m\u00edstn\u011b p\u016fsob\u00edc\u00edmi odbory je o to d\u016fle\u017eit\u011bj\u0161\u00ed v situaci, kdy doch\u00e1z\u00ed k balkanizaci pracovn\u00edho trhu. &#8222;Dom\u00e1c\u00ed pomocn\u00edci se nikdy nesetk\u00e1vaj\u00ed, a tak neexistuje \u017e\u00e1dn\u00fd spole\u010dn\u00fd \u010das, kdy by se mohli sej\u00edt a mluvit o pr\u00e1ci,&#8220; \u0159\u00edk\u00e1 Nizzoli. &#8222;Proto se odbory, jak je vid\u00edm p\u0159i sv\u00e9 pr\u00e1ci v ter\u00e9nu, st\u00e1vaj\u00ed kl\u00ed\u010dov\u00fdm f\u00f3rem pro socializaci pr\u00e1ce v t\u011bchto nejist\u00fdch odv\u011btv\u00edch.&#8220;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Ot\u00e1zka zastoupen\u00ed<\/strong><\/h4>\n\n\n\n<p>V posledn\u00edch letech se uvnit\u0159 odbor\u016f projevuje nep\u0159ehl\u00e9dnuteln\u00fd trend feminizace, kdy \u017eeny st\u00e1le \u010dast\u011bji zast\u00e1vaj\u00ed odpov\u011bdn\u00e9 funkce. Tato zm\u011bna m\u00e1 nejen symbolick\u00fd v\u00fdznam, ale pom\u00e1h\u00e1 tak\u00e9 upozornit na skute\u010dnost, \u017ee \u017eeny jsou nadm\u011brn\u011b zastoupeny v odv\u011btv\u00edch s n\u00edzkou jistotou zam\u011bstn\u00e1n\u00ed.
