Tento typ zmluvy, ktor\u00fd je <a href=\"https:\/\/www.eldiario.es\/economia\/alquiler-temporada-trampa-esquivar-ley-vivienda-precios-35-caros_1_10301716.html\">mimo regul\u00e1cie pren\u00e1jmu<\/a>, v posledn\u00fdch mesiacoch v katal\u00e1nskom hlavnom meste prudko vzr\u00e1stol a pod\u013ea dostupn\u00fdch \u00fadajov tvor\u00ed 20 a\u017e 40 % ponuky na realitn\u00fdch port\u00e1loch, ako je Idealista.<\/p>\n\n<p>Pod\u013ea r\u00f4znych zdrojov, s ktor\u00fdmi sa konzultovalo, sa jej n\u00e1rast zaznamen\u00e1va u\u017e nieko\u013eko rokov, a to s\u00fabe\u017ene so schva\u013eovan\u00edm r\u00f4znych nariaden\u00ed, ktor\u00e9 zv\u00fdhod\u0148uj\u00fa n\u00e1jomcov, ako napr\u00edklad pred\u013a\u017eenie platnosti zml\u00fav z troch na p\u00e4\u0165 rokov alebo cenov\u00fd strop. Do\u010dasn\u00fd pren\u00e1jom umo\u017e\u0148uje prenaj\u00edmate\u013eovi uzatv\u00e1ra\u0165 ro\u010dn\u00e9 zmluvy, a preto m\u00e1 v\u00e4\u010d\u0161iu vo\u013enos\u0165 pri ich zdra\u017eovan\u00ed alebo vypovedan\u00ed.  <\/p>\n\n<p>Barcelona je v\u0161ak ovplyvnen\u00e1 aj rast\u00facim pr\u00edchodom zahrani\u010dn\u00fdch pracovn\u00edkov &#8211; v\u00e4\u010d\u0161inou digit\u00e1lnych nom\u00e1dov &#8211; ktor\u00ed prich\u00e1dzaj\u00fa do mesta kv\u00f4li jeho dobr\u00e9mu podnebiu. Spr\u00e1va spolo\u010dnosti Idealista za tret\u00ed \u0161tvr\u0165rok 2023 hovor\u00ed o &#8222;raketovom&#8220; n\u00e1raste na 28 % trhu s pren\u00e1jmom v katal\u00e1nskom hlavnom meste, ktor\u00e9 je druh\u00e9 po San Sebasti\u00e1ne v \u0160panielsku. V \u010fal\u0161ej \u0161t\u00fadii Observatori de l&#8217;Habitatge de Barcelona (OH-B), ktor\u00e1 sa t\u00fdkala rekl\u00e1m tej istej spolo\u010dnosti a z rovnak\u00e9ho obdobia, bolo toto percento 19 %, ale v niektor\u00fdch \u0161tvrtiach, napr\u00edklad v Barcelone, sa bl\u00ed\u017eilo k 50 %.<\/p>\n\n<p>Odvtedy neboli publikovan\u00e9 \u017eiadne \u010fal\u0161ie \u0161t\u00fadie. Nov\u0161ia anal\u00fdza port\u00e1lu <a href=\"https:\/\/eldiario.es\/\" target=\"_blank\" rel=\"noreferrer noopener\">elDiario.es<\/a> v\u0161ak potvrdzuje vzostupn\u00fd trend. Od okt\u00f3bra 2023 do marca 2024 po\u010d\u00edtali tieto noviny ka\u017ed\u00fd 15. de\u0148 v\u0161etky inzer\u00e1ty dostupn\u00e9 na port\u00e1li Idealista. V\u00fdsledkom je, \u017ee pou\u017e\u00edvatelia sa v priemere stret\u00e1vaj\u00fa so 46 % rekl\u00e1m na do\u010dasn\u00e9 pren\u00e1jmy. V niektor\u00fdch \u0161tvrtiach v centre mesta je to pribli\u017ene 60 % (Barceloneta, Hostafrancs, Esquerra de l&#8217;Eixample a Sant Antoni).<\/p>\n\n<p>Napriek rozdielom medzi jednotliv\u00fdmi spr\u00e1vami odborn\u00edci poukazuj\u00fa na to, \u017ee o jeho raste niet poch\u00fdb. &#8222;Je zrejm\u00e9, \u017ee obydlia, ktor\u00e9 sa pon\u00fakali na pren\u00e1jom na b\u00fdvanie, sa teraz vyu\u017e\u00edvaj\u00fa na sez\u00f3nne alebo turistick\u00e9 \u00fa\u010dely,&#8220; hovor\u00ed Helena Cruzov\u00e1, geografka a autorka \u0161t\u00fadie OH-B. Porovnala tie\u017e v\u00fdvoj konven\u010dnej a do\u010dasnej ponuky a cestovn\u00e9ho ruchu v rokoch 2022 a\u017e 2023. K\u00fdm prv\u00fd kles\u00e1 o 895 bytov, druh\u00fd st\u00fapa o 830. Jeho z\u00e1verom je, \u017ee ide o komunika\u010dn\u00e9 n\u00e1doby.<\/p>\n\n<p>Okrem toho s\u00fa ceny vy\u0161\u0161ie. Jeho majite\u013eka je ve\u013ekostatk\u00e1rka, ktor\u00e1 vlastn\u00ed nieko\u013eko nehnute\u013enost\u00ed vr\u00e1tane vlastn\u00e9ho 15-poschodov\u00e9ho s\u00eddliska. &#8222;On nepotrebuje o 300 eur mesa\u010dne viac, zatia\u013e \u010do pre m\u0148a to znamen\u00e1, \u010di m\u00f4\u017eem alebo nem\u00f4\u017eem plati\u0165 za byt,&#8220; dod\u00e1va.  <\/p>\n\n<h4 class=\"wp-block-heading\"><strong>Vodn\u00e1 cesta&#8230; a podvod na z\u00e1kone?<\/strong><\/h4>\n\n<p>Pod\u013ea zdru\u017een\u00ed n\u00e1jomn\u00edkov sa existencia do\u010dasn\u00e9ho pren\u00e1jmu stala skuto\u010dnou medzerou v z\u00e1kone o b\u00fdvan\u00ed, ktor\u00e1 e\u0161te viac za\u0165a\u017euje trh s n\u00e1jmom a ktor\u00fa by mala administrat\u00edva odstr\u00e1ni\u0165. V tejto s\u00favislosti v\u0161ak neexistuje \u017eiadne nariadenie. Ministerstvo pre b\u00fdvanie zriadilo v decembri komisiu, ktor\u00e1 ju m\u00e1 presk\u00fama\u0165 a zatia\u013e sa stretla len raz, zatia\u013e \u010do Generalitat tvrd\u00ed, \u017ee pripravuje nov\u00e9 nariadenie, ktor\u00e9 v\u0161ak nem\u00f4\u017ee by\u0165 schv\u00e1len\u00e9 kv\u00f4li pred\u010dasn\u00fdm vo\u013eb\u00e1m 12. m\u00e1ja.<\/p>\n\n<p>V s\u00fa\u010dasnosti je v 140 katal\u00e1nskych obciach, v ktor\u00fdch plat\u00ed horn\u00e1 hranica n\u00e1jomn\u00e9ho, obmedzen\u00e9 zvy\u0161ovanie cien. Preto niektor\u00ed prenaj\u00edmatelia pova\u017euj\u00fa sez\u00f3nny pren\u00e1jom za skratku k zv\u00fd\u0161eniu cien. Pr\u00e1vnici zaoberaj\u00faci sa b\u00fdvan\u00edm v\u0161ak varuj\u00fa, \u017ee ak sa tak stane v pr\u00edpade n\u00e1jomn\u00edkov, ktor\u00ed nehnute\u013enos\u0165 vyu\u017e\u00edvaj\u00fa ako svoj domov, prenaj\u00edmatelia poru\u0161ia z\u00e1kon. &#8222;Existuj\u00fa prenaj\u00edmatelia, ktor\u00ed inzeruj\u00fa sez\u00f3nny pren\u00e1jom a uv\u00e1dzaj\u00fa to v zmluv\u00e1ch, ale v skuto\u010dnosti prenaj\u00edmaj\u00fa nehnute\u013enos\u0165 \u013eu\u010fom, ktor\u00ed ju vyu\u017e\u00edvaj\u00fa ako svoje obvykl\u00e9 bydlisko, \u010do je podvodn\u00e9 vyu\u017eitie tohto \u010d\u00edsla,&#8220; varuje Elga Molina, pr\u00e1vna poradky\u0148a pre ot\u00e1zky b\u00fdvania.<\/p>\n\n<p>To je pr\u00edpad Pauly Fern\u00e1ndezovej, 28-ro\u010dnej \u017eeny, ktor\u00e1 b\u00fdva v jednom byte s \u010fal\u0161\u00edmi tromi diev\u010datami v Cerdanyola del Vall\u00e8s v metropolitnej oblasti Barcelony. Hoci v dome b\u00fdvaj\u00fa u\u017e \u0161tyri roky a s\u00fa v \u0148om prihl\u00e1sen\u00ed, maj\u00fa sez\u00f3nnu zmluvu. Pred nov\u00fdm z\u00e1konom o b\u00fdvan\u00ed mali n\u00e1jomn\u00fa zmluvu na byt, ale ke\u010f sa bl\u00ed\u017eilo jej pred\u013a\u017eenie, prenaj\u00edmate\u013e im povedal, \u017ee bu\u010f podp\u00ed\u0161u zmluvu na jeden rok, alebo ni\u010d.<\/p>\n\n<p>&#8222;Boli sme zasko\u010den\u00ed a vyhoveli sme im zo strachu, \u017ee zostaneme bez domova,&#8220; vysvet\u013euje Paula. Bolo to v septembri 2022. O rok nesk\u00f4r zmluva vypr\u0161ala a museli ju podp\u00edsa\u0165 znova. Ich prenaj\u00edmate\u013e op\u00e4\u0165 navrhol dvan\u00e1s\u0165mesa\u010dn\u00fa lehotu, ale po Paulinom naliehan\u00ed s\u00fahlasili s dvojro\u010dnou lehotou pod podmienkou, \u017ee bud\u00fa zaregistrovan\u00ed ako \u0161tudenti (hoci nimi nie s\u00fa).<\/p>\n\n<p>Postavenie sez\u00f3nneho pren\u00e1jmu nie je v z\u00e1kone o mestskom pren\u00e1jme (LAU) ve\u013emi dobre rozpracovan\u00e9, ale z\u00e1kon aspo\u0148 jasne uv\u00e1dza, \u017ee je ur\u010den\u00fd na in\u00e9 \u00fa\u010dely ako b\u00fdvanie. Napr\u00edklad \u0161tudenti a doktorandi, ktor\u00ed prech\u00e1dzaj\u00fa, vysoko mobiln\u00ed odborn\u00edci alebo digit\u00e1lni nom\u00e1di, \u013eudia, ktor\u00fdch domovy s\u00fa vo v\u00fdstavbe&#8230; &#8222;O tom, \u010di je zmluva sez\u00f3nna, rozhoduje d\u00f4vod, a nie d\u013a\u017eka pobytu, ktor\u00fd mus\u00ed by\u0165 akreditovan\u00fd, a to aj prostredn\u00edctvom predlo\u017eenia pracovnej zmluvy,&#8220; dod\u00e1va Molina.<\/p>\n\n<p>Nikto v\u0161ak Fernandeza nepo\u017eiadal, aby dok\u00e1zal, \u017ee je \u0161tudent. Nemohol som to urobi\u0165. &#8222;Je to zmluva, ktorej jedin\u00fdm cie\u013eom je poru\u0161ova\u0165 z\u00e1kon a \u00fa\u010dtova\u0165 viac,&#8220; \u013eutuje. Ke\u010f\u017ee podp\u00edsali sez\u00f3nny n\u00e1jom, platia mesa\u010dne o 120 eur viac, a\u017e 1 120 eur, hoci ich byt by mal pod\u013ea stropu stanoven\u00e9ho vl\u00e1dnym indexom st\u00e1\u0165 600 a\u017e 700 eur.<\/p>\n\n<p>&#8222;Je to hrozn\u00e9, cel\u00fd \u010das sleduje n\u00e1\u0161 pohyb. V jeho hist\u00f3rii zohr\u00e1va \u00falohu aj sez\u00f3nny pren\u00e1jom.  <\/p>\n\n<p>Nehnute\u013enos\u0165 k\u00fapil katal\u00e1nsky realitn\u00fd fond v \u010dase, ke\u010f u\u017e bol zn\u00e1my z\u00e1mer vl\u00e1dy Ada Colau <a href=\"https:\/\/www.eldiario.es\/catalunya\/vecinos-comercios-oponen-peatonalizacion-consell-cent-detractor-plan-ahora-gusta_1_10497135.html\">vybudova\u0165 na ulici Consell de Cent pe\u0161iu z\u00f3nu<\/a>.
